KARACHI: Chief Justice Iftikhar Muhammad Chaudhry on Thursday observed that the federal and provincial governments were responsible for the bloodshed in Karachi. He said politicisation of the issue of law and order started whenever the court intervened. The court directed the Customs authorities to appraise the court of the number of illegal sophisticated weapons being smuggled to the country.He observed that ineffective policing and lack of prevention of crimes by the law enforcement agencies had brought this port city to the verge of destruction and the entire country was suffering from its worsening law and order situation. He said the city was generating 70% to 80% of the total revenue of the country.The court observed that the provincial chief secretary did not write even a single letter to the federal and provincial executives pointing out the grim law and order situation in the city. He asked the chief secretary why he did not make correspondence with the federal and provincial executives to apprise them of the law and order situation in the city.He observed that the police and Rangers officers will have to admit that they had failed to stop the killings of innocent people in the last couple of years and why should Rangers and police high-ups not be held responsible for their failure. The CJ observed that Karachi was bleeding and there was mourning everywhere in the city.He observed that the IG Sindh’s report on targeted killings was prima facie far away from reality. The court observed that after perusal of the summary sent by the Sindh chief justice, who presided over the law and order situation meeting with police and Rangers, the court came to the conclusion that nothing had been done in last two years by the law enforcement agencies to implement the directions of the SC. The apex court observed that government functionaries were activated only when the SC started the suo moto case on the Karachi law and order situation.The court wondered that even non-statutory body like the Citizen-Police Liaison Committee (CPLC) could assist the police in tracing out the culprits of kidnapping for ransom cases. The court, however, observed that the CPLC should be made impartial and CPLC members should not sit in the office situated at the Governor’s House.Advocate General Sindh Khalid Javed Khan produced a report on the details of targeted killings in the last two years. He submitted that during the last two years, 4,952 people, including 239 police personnel, had been killed. He submitted that the city was facing a war-like situation as judges, police and personnel of law enforcement agencies were attacked by terrorists and the morale of the police force was not so high.The CJ observed that it was not a war-like situation but in fact the police and other law enforcement agencies did not have the will to control the lawlessness and targeted killings. The court observed that the advocate general must know the consequences of giving such statements as it amounts to the failure of the police and law enforcement agencies, inviting the other ‘authority’ to take over the control. The court observed that everyone should be thankful that there was a democratic set-up, which should be strengthened.The court observed that both the governments, federal or provincial, although do not belong to the same political party but they both have to govern as per the Constitution.The AG submitted that the federal government was not issuing an NOC for the import of 20 armoured personnel carriers despite the fact that the provincial government had made payment to the importers.The AG said that the federal government could support the provincial government in providing intelligence sharing as it has a vast intelligence network. He submitted that the provincial government had no hostility with the federal government and the chief minister Sindh had assured that all efforts will be made for restoration of peace and law and order in the city. The AGP Munir A Malik suggested that advocate general Sindh could give him a list of the requisite items and assured that he will take up the matter with the federal government on priority basis.Justice Khawaja observed that the court had passed as many as 20 directives in its October 6, 2011 judgments but except for payment of compensation to legal heirs of targeted killing victims, no other directive of the court was complied with in letter and spirit.The CJ observed that the court had already declared that violence in Karachi during the current year and in the past was not ethnic alone but it was also a turf war between different groups.He inquired from the IG Sindh as to why honest police officers were not being given field postings, directing the attorney general to appoint those officers in the city who wanted to deliver and control the lawlessness. “There is no disturbance in the democratic system but the situation of law and order is deteriorating due to ineffective policing in the city,” the court observed. SP Lyari Javed Iqbal Bhatti admitted that the police could not enter into some pickets of Lyari.To a court query regarding the progress in gangster Arshad Puppoo’s murder case, former DIG South Shahid Hayat, who is now the DIG Special Branch, submitted that he had been transferred from the post. DIG South Dr Amir Sheikh admitted that there were operational difficulties in conducting raids in the localities of Lyari as criminals used women and children as shield. He said the police force was demoralised due to discrimination and unfair transfers and postings and undue pressure from the high-ups.Chief Collector Customs Mohammad Yahya and Custom Collector Nasir Masroor said that they did not know as from where the illegal arms and ammunition were being smuggled. They said the Customs authorities had only a 1,700 personnel force for checking the 1,900 kilometre land and 1,200 kilometre coastal line.The court observed that criminals and terrorists had got the latest and sophisticated weapons and it was the responsibility of intelligence agencies to trace from where the illegal weapons were being smuggled.The AG Sindh submitted it was reported that a big ship of illegal weapons in former President Pervez Musharaf’s regime was smuggled in the country adding that Karachi was full of illegal weapons. The court also issued notices to the federal and provincial law officers on the application of former Pakistan Ambassador to United Nations Abdullah Hussain Haroon and former caretaker chief minister Sardar Mumtaz Bhutto regarding migration of Katchi community from Lyari and special police protocol to the Pakistan People’s Party leaders and activists. Haroon submitted that the Katchi community members had returned to Lyari on the assurance of the commissioner but were attacked when they returned to their homes.
