BC PlaceBy Bob MackinMon Jul 22,moncler on sale, 2013 4:42pm PSTThe multimillion-dollar trial over the BC Place roof renovation, which was scheduled to begin October 21, has been postponed for several months over delays in examinations for discovery and expert reports. Justice Gregory Bowden ruled today that the trial is now scheduled to start February 3,moncler outlet, moncler outlet, 2014.French cable installation company Freyssinet, which initiated the action, is suing steel contractor Canam for $6.5 million, moncler down jackets, which it claims was it was owed for installation work. Freyssinet named BC Pavilion Corp. (PavCo) and general contractor PCL as secondary defendants.Quebec-based Canam responded with a countersuit for $39 million. Canam's countersuit blamed Freyssinet for broken or failed equipment and a disagreement over construction methods that ultimately delayed installation of fabric for the new retractable roof.Canam lawyer Stuart Hankinson said his client is "anxious to go to trial, but ... also fairly sophisticated and understands the realities of the trial process.""October 21 is an ambitious trial commencement date, moncler on sale, my clients have instructed me to press on with vigour, moncler down jackets," Hankinson said before Bowden's decision. "If my friends are allowed to provide their expert reports on the timetable they've identified, I will not be in a position to start October 21."The parties agreed to a "three weeks on, one week off" schedule, meaning the 102-day trial will stretch well into summer 2014. Hankinson suggested the parties use the delay to explore whether an out-of-court settlement is possible, despite the disparity of their claims."We haven't even discussed with your lordship, as a case-management judge, the alternatives of mediation or court-ordered settlement conference or something to try and resolve the issues between the parties," he said.Canam applied in June to sever the parallel dispute over roof support cable grease leaks, discount moncler jackets, discount moncler jackets, moncler sale, because it could result in further delays. The June 12 application said some repair work to the outer fabric was done for $6.7 million plus taxes, but supplier Shade World Wide Inc. has advised that "significant repairs are required to both the outer roof fabric and the inner liner" for an estimated $19.4 million, "bringing the total estimated cost of repairs to approximately $26.1 million."The Canam application said Shade refused to provide the warranty for the outer roof fabric and interior acoustic liner to PCL. Mediation among the parties on May 28-29 was "unsuccessful in resolving those claims."The filing said that, should the claims over the grease leaks not be settled in the near future, "it appears to Canam that PavCo will commence an action to obtain its roof membrane warranty from PCL and to recover any damages it has suffered. PCL will in turn commence third-party proceedings against Canam, Freyssinet, FIC and [cable supplier] Geobrugg for contribution and indemnity."BMackin@biv.com@bobmackinTags: law, civil law, BC Place, British Columbia Pavilion Corp., management
