KARACHI: The SC on Monday threw out an appeal of Shahrukh Jatoi, the prime accused in the Shahzeb Khan’s murder case, challenging the decision of the Sindh High Court (SHC) on his trial under the Anti-Terrorism Act 1997. A division bench of the apex court, comprising Justice Anwar Zaheer Jamali and Justice Sarmad Jalal Osmani, upheld the decision of the SHC, which had dismissed the petition of Jatoi challenging the jurisdiction of the ATC to conduct the trial.Shahrukh Jatoi, Nawab Siraj Ali Talpur, his younger brother Nawab Sajjad Ali Talpur and their house servant Ghulam Murtaza Lashari have been charged and convicted with the murder of 20-year-old Shahzeb in the Defence Housing Authority on the night of Dec 24, 2012 after bickering. He submitted that the investigation officer had added Section 7 of the Anti-Terrorism Act, 1997 in the charge-sheet only because of a media campaign against him though the FIR lodged against him did not contain any element of terrorism.He submitted that the case did not fall within the ambit of the anti-terrorism law. The court had dismissed his plea observing that sufficient evidence was available on record to prove that the case falls within the ambit of the law.
